• ACTis has raised five flags for uMngeni-uThukela Water and placed two under monitoring.

• Concerns regarding the appointment of the Chief Executive Officer (CEO) and the implication of Board members in abuse-of-power reports suggest that uMngeni-uThukela Water’s leadership may be compromised. In state capture patterns, this is closely linked to a climate of fear or favour, in which staff who align with irregular decisions face no consequences, while those who resist are sidelined.

• Findings under the Corrupt Awards, Financial Malpractice and Private Gain flags are clearly linked. Rather than reflecting administrative weaknesses, these repeated patterns suggest that current conditions are enabling the extraction of value from uMngeni-uThukela Water and its subsidiaries. They also indicate the possible involvement and influence of individuals linked to construction-related extortion networks within the entity’s governance structures, reflecting patterns associated with state capture.

• The obstruction of accountability has allowed problematic practices to persist despite repeated warnings from the Auditor-General of South Africa (AGSA), labour unions and whistleblowers. While the initiation of investigations is promising, the need for external intervention, including the Minister’s involvement, underscores how ineffective internal accountability mechanisms have been.

• The relationship between uMngeni-uThukela Water and the law firm Strauss Daly involves potential conflicts of interest.
